DMCA Policy

Well Aware Globe (“we”, “us”, or “our”) respects the intellectual property rights of others and expects users of our Site (WellAwareGlobe.com) to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our Site if such claims are reported to our Designated Copyright Agent as described herein.

1. Our Commitment to Copyright Law

Well Aware Globe is a health and wellness publication committed to producing original, high-quality editorial content. We take copyright infringement seriously and have adopted policies, procedures, and standards designed to prevent and address copyright violations on our platform. We take prompt action upon receiving valid copyright infringement notices and will remove or disable access to allegedly infringing content as required by law.

2. DMCA Notice of Alleged Infringement (Takedown Notice)

If you are a copyright owner, or authorised on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Site, you must submit your notice in writing to the attention of our DMCA Agent and include in your notice a description of the following:

  • An electronic or physical signature of the copyright owner or a person authorised to act on behalf of the owner of the copyright interest.
  • A description of the copyrighted work that you claim has been infringed, including the URL (web page address) of the location where the copyrighted work exists, or a copy of the copyrighted work.
  • Identification of the URL or other specific location on our Site where the material that you claim is infringing is located.
  • Your address, telephone number, and email address.
  • A statement by you that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner’s behalf.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. If you are unsure whether the material you are reporting is indeed infringing, you may wish to contact a legal advisor before filing a notification.

3. Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorisation from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the content in your submission, you may send a counter-notification containing the following information to our DMCA Agent:

  • Your physical or electronic signature.
  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good-faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court located in your jurisdiction, or if your address is outside the United States, for any judicial district in which Well Aware Globe may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notification is received by our DMCA Agent, we may send a copy of the counter-notification to the original complaining party informing that person that we may restore the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed content may be restored or access to it restored in 10 to 14 business days or more after receipt of the counter-notification, at our sole discretion.

4. Repeat Infringers

It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts or access of users who repeatedly infringe the copyrights or other intellectual property rights of others. We reserve the right to take such action at any time, with or without notice, in response to confirmed repeated copyright infringement.

5. Accommodation of Standard Technical Measures

It is our policy to accommodate and not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works that we have determined are reasonable under the circumstances, meaning measures that are used pursuant to widespread adoption by copyright owners and service providers, available on reasonable and non-discriminatory terms, and do not impose substantial costs or burdens on service providers.

6. Changes to This Policy

We reserve the right to modify this DMCA Policy at any time. If we make changes, we will notify you by revising the “Effective Date” at the top of this policy. Any changes will take effect immediately upon posting. Your continued use of the Site after the posting of changes constitutes your acceptance of such changes.

7. Limitation of Liability for DMCA Claims

Well Aware Globe will not be liable for any damages, whether direct, indirect, incidental, special, or consequential, arising out of or related to any DMCA takedown, counter-notification, or actions taken in good faith in response to claimed copyright infringement. We act in good faith upon receipt of proper DMCA notifications and follow the procedures set out in applicable law.
